Short description of the contract or purchase(s)
West Berkshire Council requires a Contractor (Service Provider) to help manage and provide a Winter Service in line with its Code of Practice for Winter Maintenance. The specification for the service will require for the provision of a Road Weather Forecast and Information Service for the county of Berkshire.
The Service will comprise of the following main components:
The Council operates an Ice Prediction System, whereby road weather information sensors (outstations and potential non-invasive outstations) are installed at a number of locations on the road network throughout the County. These outstations provide actual information on road conditions and this information is available for use in compilation of forecasts. The Service provider will be expected to manage this information and present in a format acceptable to the Council, for use by its duty officers.
Maintenance and operation of the outstations will form part of the contract including, inspection, calibration and call-out repair of the equipment and maintenance of pc based ice prediction software and web access.
The majority of the network has been previously thermal mapped. Display and maintenance of the thermal maps will form part of this contract.
The operation of a forecast service that utilises the data from the outstations, to enable, by remote monitoring, the road surface and atmospheric conditions for the detection and prediction of ice formation and other adverse weather conditions.
Provision of daily weather forecast at the specified times between 01 October and 30 April each year.
A route optimisation service if required.
A thermal mapping service if required.
24 Hour office based telephone consultancy service throughout the winter period.
Telephone consultancy service covering all services during work hours outside winter period.
Annual training of winter decision makers.
Data handling, quality monitoring, fault notification and storage.

Information and formalities necessary for evaluating if requirements are met: Any supplier may be disqualified who:
(a) is bankrupt or is being wound up, where his affairs are being administered by the court, where he has entered into an arrangement with creditors, where he has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;

(j) has been the subject of a conviction for fraud within the meaning of Article 1 of the Convention relating to the protection of the financial interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined in Article 1 of Council Directive 91/308/EEC of 10 June 1991 on prevention of the use of the financial system for the purpose of money laundering.

Additional information:
- All applicants that express an interest are required to complete a pre-Qualification Questionnaire (PQQ) and a Technical Questionnaire document which seeks information including economic and financial standing, technical ability and experience. Failure to answer all questions in the PQQ and Technical Questionnaire document and provide supporting documentation requested may result in disqualification.
- The Technical Questionnaire document shall be assessed in the first instance, and if the assessment of this document does not reach the required level, the Council will not take your expression of interest any further.
- Applicants that wish to submit an Expression of Interest as individual organisations or as part of a consortium are invited to do so.
All Expressions of Interest must be made via our Procurement Portal - http://westberks.klickstream.com/ Suppliers will be requested to register in the first instance. This is a Free Of Charge service. Once registered, applicants will be able to download the Pre-Qualification documents.
- The PQQ documentation must be returned in hardcopy to the address stated on the covering letter (F008a)
- The deadline for receipt of the completed Pre-Qualification document(including references) and Technical Questionnaire document is 12 noon on Monday 26th July 2010.
- During the Tender Period the deadline to request any further information will be approximately 10 days prior to tender return date
- The Council reserves the right to not award a contract.

Lodging of appeals
West Berkshire Council will incorporate a minimum 10 calendar day standstill period at the point information on award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be required from address detailed in I.1 If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No.5)provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court(England, Wales or Northern Ireland). Any such action must be brought promptly(generally within 3 months). Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. (The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside the award decision before the contract is entered into).
